Activist Judges

Wingnuts are wont to start screaming "activist judge" every time a court ruling runs contrary to their agenda. But you can go against common sense, legal precedent and the Constitution as much as you want as long as the direction in which you stray is toward the right:

Despite a slew of independent investigations exonerating ACORN of misdeeds, on Friday, the U.S. Second Circuit Court of Appeals overturned federal court Judge Nina Gershon's decision that cutting off ACORN's funding punished ACORN without a trial. Gershon had ordered the United States government to restore ACORN's funds.

The U.S. Second Circuit Court of Appeals is made up of two Republicans and a right wing Democrat Daddy Bush once wanted to nominate for the Supreme Court. Absolutely no judicial activism here...
